“Pela condição natural de todo ser humano e pela força da lei”: ações de liberdade e abolicionismo em Minas Gerais

Resumo

O presente trabalho tem como objeto a análise da ação de escravos e advogados na luta pela abolição nos tribunais das cidades mineiras de Ouro Preto e Mariana, entre os anos de 1871 e 1888. As ações de liberdade, processos judiciais movidos por escravos contra seus respectivos senhores visando a liberdade, representaram um importante campo de luta pela abolição. Através da leitura dos processos é possível observar as estratégias tecidas pelos escravos para alcançar sua liberdade, além da forma como os advogados envolvidos se posicionaram em relação à escravidão e à abolição. Foi possível ainda perceber as ligações entre o movimento abolicionista e as lutas judiciais, sobretudo nas contendas em que o escravo alegava ser um africano importado para o Brasil após a lei de proibição do tráfico de 1831.

Abstract

That work has as object the slaves’ action and lawyers in the fight for the abolition in the tribunals of the cities of Ouro Preto and Mariana (Minas Gerais), between 1871 and 1888. The actions of freedom, lawsuits moved by slaves against your respective gentlemen seeking the freedom, they represented an important fight field for the abolition. Through the reading of the lawsuits is possible to observe the strategies made by the slaves to achieve their freedom, besides the form as the lawyers involved in these processes they were positioned in relation to the slavery and the abolition. It was possible to notice the connections between the abolitionist movement and the judicial fights, above all in the contentions in that the slave alleged to be an African imported to Brazil after the law of prohibition of the traffic of 1831.
